The owners of the American Grill on Seneca Street in East Aurora want to construct a pavilion behind their restaurant that could be used for weddings and other catered events.
The restaurant, owned by Jay and Tisha Macaluso, is in East Aurora, while the empty land behind it is in Elma.
The Elma Town Board will set a public hearing on the plan when it meets at 7 p.m. Wednesday in Elma Town Hall, 1600 Bowen Road.
Although the proposed structure would have a roof, it would not have side walls at first.
The parking would be off Seneca Street in East Aurora. A buffer of trees would separate the structure from nearby neighbors on Billington Drive.
Those neighbors were present at the Aug. 21 board meeting, expressing concerns about the possible noise from music at the site sparked by slingers put in their mail boxes by unknown people. Currently, the restaurant has an outdoor bar, a volleyball net and music, which also prompted objections from many neighbors.
After a public hearing on a fill permit, the Town Board voted to approve it at the Aug. 21 meeting, with exemptions. Driveways and parking lots, both industrial and commercial, will be exempt as they go through a different process that includes approval by the town engineer of driveways with a new house permit, and a site plan approval with the Planning Board for all commercial and industrial buildings.
A newly tweaked fill permit requires the property owner to fill out a form stating the origin of the fill, the purpose and extent of the operation, type of fill, insurance by contractor and affirmation of the owner that the fill being brought to his property is free of any contaminants.
The owner also must agree that any fill that is found to have contaminants will be removed immediately.
Violations will be subject to fines by the state Department of Environmental Conservation.
